Final statement by Mur, Archived here after being removed from the code in MD:

Jaco vs Granos

Case Details

Jaco accuses Granos for not keeping his end of a trade.
Jacos initiated a public auction for his "quot;Golemus Pass Papers" item.  He got a offer from Granos saying he would give him a GG Drach with 251 age for it. Offer was made anonymously. Granos provided partial CTC so that Jacos could check his validity, they agreed on the trade, but when jacos sent his item Granos vanished. Later on a statement of Granos on the forum shows he admited this to be a deceiving of Jacos. Overall forum reaction was that Jacos was greedy to accept a drach for an item and that there is no rule against that and its a risk of the trade to get cheated. Also Granos particular role was mentioned as something in favor of his action. Question is raised about the impact of this action on general trading in MD and on where the boundries of a villen role are.

Judges/Jury Opinion:
There is robbery, stealing and cheating. Robbery is when you take by force, it keeps your honor unless the gun you use its to big for you. Stealing is worse but not the worse thing you could do. Stealing keeps your honor only if you are doing it professionaly and you raise it to a state of art. Cheating is the worse you could do, it involves getting under the skin of someone, gain his trust, then fuck him, without even the reason of revenge.      Granos reputation was big part of the deal, because i doubt Jaco would send his item first to a new player that promises a drach for them. Giving out that partial ctc as proof, clears jaco of the "stupid greed" reason because he had proof granos has the drach to trade. There is nothing more he could have done to ensure a fair trade. Having a role of a general scamer is possible but it comes with the risks. You cant pretend you can get away with it just because "you do that". Its like godmodding if it is allowed. Because of his particular role, this action will probably add up to his reputation. Being a veteran player his action stand also as an example for new players so his punishment will be an example too.

Final Decision or Punishment
Granos found guilty as charged.
Good factors (one):
Admited before judgement: Yes
Fixed situation in time: -
Special Factor: Considers he did it on purpose to set an example

Bad factors (one):
Refuse to cooperate: -
Recidivist in same crime: -

Additional crime: yes (used for confirmation CTC not of his own)

Special Factor: First case to reach a trial regarding item fraud, punishment higher.

PUNISHMENT

Global Influence on MD
Theft is not restricted by MD law. Trials will apply only if you are unlucky so to say. If you want to be a thief or villen you should be ready for the risks.
Collected proof:
No request was made for a detailed log trace of the item or creature trades between the two. Assuming both sides agree on the facts.

Forum reply of Granos showing him admiting his action:
"Touching words, but it was nothing more than pure deceit, although through word play there is a loop hole but I would rather see what there is to suffer.
Do your worst."

JacoAnd auction for the item was public so his intentions to trade it are proved.

Granos final statement:
In regards to the fraudulent activity I fully admit to cheating JacoAnd out of his papers with a non-existent creature and that upon receiving the item in question I made sure to give them away for free to an undisclosed party/individual whom of which will remain anonymous and is not Canadian or one of my alts. This being said, the punishment should be extreme as I do like what I have seen par the reactions of others in regards to this event, as if I were not me and say Fenrir or Redneck people would be demanding my head in a noose which to me is a double standard, which is something that disgusts me. Do not do the crime unless you are willing to accept the consequences. This was done entirely planed on my part and JacoAnd was merely a victim of convenience, the intention of such an action is in part to have society stop focusing on greed, show people there is a fine line between "villiany" as they put it and simply being a Jerk. Something to which was free to begin with was taken for free and then given again for free, people may ask who am I to make such a judgment, I am simply Granos.

Also,
Everything I have and am has been earned by only myself with nothing given and for the few things I have received in excess I have given away freely to others.
