Claim against Backlash Ro

Backlash Ro was banned from the forum today following incredibly offensive and rude personal messages he sent. This was after warning him that any continued offense would get him banned.

The act of banning him so readily was made due to a number of reasons, All moderators indicated that something needs to be done about him two of which recommended banning. I sent him a message telling him to be careful of what he says and such and in the following replies i received was enough that the agreement of a ban was decided on. If he used the forum for other purposes then he would not have been banned, merely had some rights removed for a period, But since the level of rudeness was exceptional and he had only posted to complain on this topic, it was decided to ban him.

His term of Ban will be 4 weeks as ingame sentence, With additional post moderation after his sentence is over if it is deemed necessary.

I apologize to those that have gained any, or more, offence from Backlash due to this post. Though I felt it was required to bring it all up, to stop those that play in the future from getting any abusive language thrown at them. Though it seems that he will not see that he is completely in the wrong here, and that everyone else is.

In regards to Grido's second PL entry evidence, I had no idea this one was written, and now....well do I have to even mention how offensive this is to me? I would personally ask for him to gain an IP ban, and I am willing to fight for this if I must.

I hope my two posts make enough sense for others to see what I see, it seems that the first has done so.

P.s I have not responded sooner due to work in RL and also wanting to allow others to give their opinions, not just have posts in which I ramble on about him with a "hot head". :)

The the IP ban is not necessary, at least for now.

Why? Because he is not using an alt to keep his incorrect behavior.

Let's see what happens after he get out of the actual bans.

I hope he change his mind, but if he don't then there might be other consequences.

Are you sure? Backlash Ro was an Alt according to Grido.

As I said before Backlash is/was an alt from a much older player, he has been banned before and nothing has seemed to change. Why should he get a third chance to be abusive to others?

Because we as a community are forgiving, Do we say that because you have abused alts and such several times, that we ban you forever because you have "continued to"? No, each sentence is punished, and once the time is dealt it is forgotten.

Look at CrazyMike for another example. He, in my opinion was very lucky, because to state a previous announcement to his previous Bug Abusing offences:

[2009-11-19 17:37:29 - Alpha 9]
UPDATE: CrazyMike and Unknown Entity got max Ve cut by half. They will also be the first to experience the effects of the new "curse" spell that will drain huge amounts of stats and do them skilldamage for each lost fight for the next week or two. Next similar abuse gets you permanent ban.

Obviously it was decided, That he was not to recieve this offense, and i believe its right not to.

I am sorry, but i will have to veto your decision out. backlash is out of jail sooner. please read below.

reasons:

- this is obviosuly a personal fight between two players that one of them decided to take into a potential jailing of the other part, i dont like that, especialy the recomandation of the jail time. The jail time is for the one doing the punishment to decide not for the accuser.

- one month jail is extreme considering the only real evidence i could see in your discussion points to this personal fight and a few offensive lines. If you jail someone for that one month then what punishment value will my jailings have when i punish a major abuser "just" two month.

- some of the "evidence" that was claimed here were pure assumptions

- the fact that one of his other accounts did jail before is not decisive to punish him. What chance would anyone have if we start jailing all their accounts in line just so. This mass jailing should be reserved for realy bad things, like scams or massive abuses, NOT for punishing personal fights.

- it is undeniable that he has an offensive attitude and that he should have not spoken like that regardless of reasons, especialy in public places. the mood panel entry alone is serious enough. For that he did one week of jail already and will receive the warning at the end of this post.

I believe a mass histeria turned into a public stoning, and a very very rude person got his actions exagerated and ..punishment badly judged.

warning to backlash: If i see any more similar talk on your side you will get 4 month of jail without warning and immediatly without a trial of any sort. This is basically your one chance to change or leave. It also means that anyone pissed enough on your disrepectful attitude will provoke you to get you jailed...you WILL get jailed if you don't learn to controll yourself, and you will get jailed at first mistake from now on. Espressions like "give it to me bitches" have a different context meaning in romanian, i know, it means like "i am the strongest"..regardless ..you are not among your fellow tribe members to speak like that, you are in an international community that sees such talk as offensive, and it is. Respect in md is earned and becomes mandatory, when you address to people that earned their status in here you talk respectfully, not like if you are beer friends. "nu ati mancat din aceiasi oala, ma intelegi". If you can not understand such basic concepts then its game over. If you get in jail again for talking like that, after 4 moth when you will be out, if you do it again, the punishment will be 6 month, and so on, till eventually you will give up disregarding this warning.

For now you are free and i consider this trial as i said, a mass histeria that i do not enjoy seeing. Its up to you how serious you take it from now on. Players that were in similar situations like you managed to understand what respect is, and they even got in highly important public roles. Your reputation has a chance to get rid of any stain, i will always treat anyone as i think fair.

Enough said

You overturned it, okay- I would still like to point out he received warnings from multiple LHOs before, which is also stated in his PL log. We just never bothered to take print screens before.

His very actions were to see how far he can push us, for a rather long amount of time, this wasn't a one timed event.

Enough said, anyways.

Just a note: I do have also some print screens and a log. My fault for not posting them...

If he continues on his path, he will get what is coming to him. He needs to change immediately, or feel the Wrath of Love.

Give him another chance, don't harass him until he blows up again. It will only make matters worse. Yes, you don't like him, but that doesn't give you the right to retaliate. If he gets banned, let him do it on his own accord.

Mur as much as I respect you, I see your reprimand completely ridiculous.

As for this reason, completely ridiculous. Do I have to point out that all of the current cases have been between two people? Dst and Fenrir, Granos and Jaco. What makes this any different from the case between Dst and Fenrir? Also where you say.

If in real life someone were to do something serious enough to go to jail, THEY wouldn't choose how long they are in would they?

He is saying that the punisher, i.e. Grido, is the one who is to set the duration of the sentence, not the one who is on the receiving end of it.

Besides that, a quote from the Dst v Fenrir trial page:
People fight, a lot, and putting an official punishment on personal argues between people will have a bad outcome on the long run. This case might set a precedent regarding the level of personal fights that can be considered a punishable act.
You guys were really unfair,i apologize if i made a mistake or anything similar,i wasn t aware. You can belive me or not,it dosen t really matter. The fact still remains, that you guys talk about equals and respect and other stuff...but did any of you botter to apologize for the sentence you almost gave me?If it wasn t for Mur I would still be locked up.I thank him for taking matters into he s own hand and saving me from that fate.

Thank you
backlash ro

The sentence was more than fair. You have been warned multiple times by almost all the LHOs but you continued to break the rules, to insult people and to swear.

You're lucky cause Mur likes "bad boys" otherwise you would have rotten in jail. But don't count on his help next time you'll do a mistake.

Well, good luck to backlash ro. There is a verdict (well, two even) - pointless really to discuss. Minor point:
1. It seems many ppl in this thread didn't have anything constructive to add as posts (avoided polluting the forum, myself included) but forum reputation counters seem to indicate it was _not_ personal vendetta of sasha lilias. I was a witness to several exchanges between these two and it was not a fight but one-sided abuse
2. I recall during the previous Tombola one player dropped a few minor 'overstepping remarks' and got immediately warned that further similar transgressions will mean jail sentence. Here it seems dirruption was much more severe and repeated many times despite multiple warnings from various LHOs (3+) - and then verdict overturned despite ... interesting defense

You didn t say anything constructive either...So thank you for your time Xrieg.

1. As mur pointed out, in Romania, the phrase that Backlash has given had different meaning in Romania than it does in other countries. So, cultural differences come into play, despite how rude, and absurd they may have been.

2. Not everyone in different countries can interpret things correctly. We are a multi diverse group of people coming from all over the world.

3. Backlash has been sentenced-- but not in the way that you all would like. If he effs up, he effs up. Then you can do your little party parade. But until then, he's here, and so you should deal with it.

4. Given the 'sentencing' of Mur, is there not a direct change in how he behaves? Sure, he may appear to be an annoying runt in some eyes, but seeing as how he has both responded kindly and respectfully to all of your posts, I do not see how he deserves the negative marks against him.

5. He is a fellow player, and like it or not, we have to deal with him. There are plenty of people out here who have had nasty reputations, and yet gotten the get out of jail free card. How is he any different to be unaccepted by the community? To target someone and to strip them of community privilege is a nasty enough sentence that he put on himself, but who are we to bother shoving that against him?

I am not saying what he did is just. I am not agreeing with his behavior. I am stating the things that seems to have been forgotten in light of this happening. I personally dislike how he treated the community, and while I have personal thoughts as to how this could have played out, I will not state so. Put it to rest already.
